If you think he’ll put up a stink about it then 100% yes and in writing like at minimum a text message. If he won’t hold it against you and trusts you with the baby out of state for a vacation then that shouldn’t be a problem but best to get it in writing just to be safe, even a text saying hey I’m taking (baby’s name) to (state) for (x amount of time), are you ok with that? And his yes response is what would cover you against him holding it against you.
I've never had to have written permission to do anything w my kids (travel, doctors, etc) married or not. I'd think the only reason you would, would be if yall had a court agreement
