They need to give you an SMP1 form regardless and they will tick the reason why they can’t pay you SMP.
In my knowledge you won’t get any of those if you have no contract, you have to be legally employed for 26 weeks on a contract. But you can apply for : New Style Employment and Support Allowance :
I’ve been told I can get maternity allowance just wasn’t sure on the form, not sure how interested they will be to give me the form but I will ask and hopefully won’t have any issues! Thank you
As I said before if you are not employed legally with them, they can’t legally issue any form, because you’re not employed person by contract. When applying for SMP they check those things and you have to provide proof that you have worked for 26 weeks this year, the only grant/benefit you can get is the new style employment and support allowance. :) hope this helps x
I am employed legally by them, just never signed a contract, no one has , but get proper payslips from them and everything reported to hmrc, also worked there for more than 26 weeks, my bad probably worded it wrong.. my worry was more they was closed for the whole of January and now they are saying there is no hours going forward.. just worried they won’t give me the form I need, but I will ask if I definitely need it, just don’t know what to do if I don’t get it
That sounds really dangerous, no contract but they pay you ? I have never heard of it before, they are doing something illegal x I hope it all works out for you hun, and if you don’t get your form from them, you still have the other option x

I applied for MA without a SMP1 and it’s been approved. Just put in the notes box that you didn’t work atleast 1 day a week within the qualifying period 😊
You will need a form from them to say why they cannot pay you SMP, as DWP will ask for this when you’re applying for maternity allowance
