Long story and I apologize if stuff doesn’t make sense or is spelled incorrectly as I’m driving, and I’m literally using speak text

OK ladies, I need your help with this and who would be liable. My three year-old son was attacked by a neighbor‘s dog so we live in an apartment complex that’s for low income and you’re not supposed to have any pets at all, which obviously people sneak them in and this dog was tied up in this person, so called backyard even though technically we don’t have our own backyards as again it’s like an apartment complex so it’s pretty much public. Well I was trying to get my son loaded into the vehicle and to get our belongings and he kind of ran ahead to the other side onto the grass where I could still see him. (Not near a road at all just across the walkway onto the other grass so there’s no traffic or other vehicles coming in/out (wanted to specify that (It’s just he was walking away from the vehicle and usually there’s a cat over there. He likes t9 pet that walks around so I just assume that’s what he was doing I did call for my son to come back twice (i could obviously still see him, he was maybe a few feet away) I was like OK but of course being three he likes to test me so I started walking to grab him the next minute, this dog tackles my son running from around the corner my son is on the ground dog on him is growling and biting my son pulling him along 4-5 feet shaking my son. I obviously tried to pull my son off, which I was able to and the dog started coming after me so I just scooped my son up and we started running back to the car which the lady was trying to pull her dog off as well and she comes over to me to apologize but I can’t help but feel guilty as my son did wander over there, but in this lady usually is friendly, but then I’m also kind of mad because I know you’re not supposed to have dogs at all there and the fact that you left it tied up unattended knowing that there’s other kids around and people that walk I don’t know what to think if someone could help me out with what to think it had to view. This we did call the police officer in the ambulance who said thank God. His injuries weren’t more bad than what they were as they expected worse they said to just go get it checked out at the hospital just in case if he needs to have any vaccines or to get it properly cleaned up and I did explain you know how my son was walking over there, but they said regardless, even as someone else’s property, it didn’t matter the dog still bit him but again I can’t help but feel like it was my fault and I feel like I should go apologize to the lady but then again here’s where my mind goes back-and-forth if you have any sense that your dog could be a mean dog which she claims he isn’t you shouldn’t be leaving it unattended anyways

If a dog ever bit my child like that I would make sure the dog went to sleep and never woke up. It's not your fault. People should be held accountable for their pets.

@Haley I felt maybe I was at fault since I didn’t catch him fast enough since he wandered over to her backyard but then like people were telling me it’s an apartment complex so technically it’s not hers. It’s public which I know people walk around all the time and I feel knowing that you’re an apartment, you should never even leave your dog tied out. It should be on a leash and you walking him, but the apartment complex in the lease you’re not supposed to have animals at all which obviously people do cause they don’t care but then I’m like can I get her in trouble because it’s violating the lease and my child was insured, but then I don’t wanna be that dumbass that takes things into. I don’t know out of order. I don’t know how to word this, but at the same time, I’m pissed because a three-year-old was tackled and shook it and dragged and bitten by a dog.

I’d say primarily it’s her fault because if the dog was never there (how it’s supposed to be) then it wouldn’t have happened. But you also need to pay more attention to your child and any and all dangers that may arise. I know it could be hard multitasking and such and our 3 year olds have a hard time listening. I don’t let my kid 3 feet away from me while loading into the car as cars pose a threat as well. But she does deserve to be penalized at the end of the day. Dogs even “nice” dogs have the potential to be aggressive and should not be unattended in public.

You need to sue. That’s ridiculous.

@Acacia it’s not like I couldn’t completely see him. He just went towards the bush onto literally lawn. That was all public as it’s for the whole apartment for walking and hanging out and living space and the dog just pulled from her back door rented. It was on a leash or a chain whatever you wanna call it that was super long and then I was told that she had to get rid of the dog and that it was supposed to be quarantine for 11 days but a few days, but I saw her walking the dog and she still has it so I’m pretty upset because I found out from other people at the apartment that it’s already bitten and attacked three other people here.
