Has anyone claimed for medical negligence?

They cut through my baby’s back leaving a scar when carrying out my C-section it left a scar as well..

Reading this made me so angry for you both. I’m so sorry that happened. I hope you’re both doing okay. I don’t have any experience or advice. But definitely file a medical malpractice lawsuit against them! That is unacceptable.

Yeah my sister got a lawyer and everything it took a while… and after 3 years she got 1.5 million dollars

Obviously your situation is different but it’s still medical negligence get a lawyer asap!

I would definitely seek legal advice. Get a copy of your medical records and go from there.

@Kish thank you, it is unacceptable I was worried at the time and didn’t want the scar to get infected either :(

@Amy it was emergency since I wasn’t given an option either! It was a nightmare of a birth to be honest

Okay, not that that should make a difference and I'm sure there could be midwives/other hospital staff who know more than I do. But depending on the level of emergency, getting your baby out would have been priority. That's not to say negligence should be ignored, I'm hoping they saw when baby was assessed and appropriately addressed what happened with you. But having seen emergency c-sections as a student. They are quite literally on a time clock as to how quick they need to get baby out. All I'm saying is they wouldn't have meant to harm baby, but it can happen just like with forceps etc. It's more how it was dealt with after I guess I'd be concerned about. Please know I'm saying this for extra understanding of the environment not to invalidate your feelings on the situation xx

Check the paper work they give you in the pre op (if it was planned) or any paperwork before (if it was not planned) in my pre op they told me due to how close the last layer is to the baby there’s a slight chance of a small cut on the baby’s skin. That was there as one of the risks. When I signed that paper I agreed to all the risks involved within a c section.

@Amy I can understand where you are coming from- from start to finish it was a nightmare of a birth from midwives telling me misinformation- from having too much intervention and then having a C-section and then my son having a cut on his back.

I can absolutely understand that, it sounds like a very distressing situation. And even as someone more aware of the environment I'd hate to be in the same situation. I'd definitely seek advice, maybe look at a PALS complaint too, as they should take those seriously xx
