EBT problem

So, I’m trying to get EBT but my oldest sons father has him on his case. However, my son does not live with him. He stays at his dads maybe 1-2 days. I only work 2 days out of the week, and I need the EBT, plus I have a 6 month old. What should I do? I tried calling & they said since he is the paternal parent, then he has the right. I don’t think that’s fair. I tried applying for just my youngest son, but they said “I make too much”.

If your son lives with you then your his residential guardian and what his father is doing is fraud. Doesn’t matter if he’s his paternal parent he doesn’t reside with him. You can always speak to a manager at the HRA office and let them know the situation

yup that’s what I’m going to do! I’m going to go in Tuesday. Bc that lady on the phone did not help me. She made it seem like it was ok for him to be doing this. Thanks! He lives fully with me. I have him on my lease and everything

yeah he’s not allowed to do that honestly and you can also bring a letter from his school as well to help with your case. You sons father is going to get in trouble because your son lives with you full time and not him

okay. Thank you for the advice. I’ll go in person this week

yeah it’s best to go in person because they won’t help you through the phone

You have to proof baby lives with you, maybe you need a hearing for that? Or talk to his dad about it

yea, I have papers saying he stays with me, school papers, lease, etc. I tried telling his dad to take him off, and he says he needs it more than I do. Mind you he lives by himself with his mother.
