Paying enhanced Maternity pay back

Hi
Does anyone know the answer to this please

I requested flexible working hours from my employer but they have refused this so now looking to leave. However, My employer has been giving me enhanced mat pay for the (20weeks) which is equivalent to something like 3.5k over the 5 months.

In their family friendly policy all it says is that I will have to repay this back if I don’t return back to work but nowhere says if I do return to work how long I will have to work there for so I don’t have to repay it
Please see attached paragraph.
Iv spoken to ACAS but even they says it’s open for interpretation that is and can’t comment

Any employment lawyers on here please?

I think you’ll need to clarify with your HR department, but I think the “usual” rule is going back for 12 weeks after Mat leave to avoid paying it back x

I would read that as you need to go back to work for at least 3 months to avoid having to pay back the enhanced maternity pay xx
