Fact finding hearing.. please advise..

My case may develop to a fact finding hearing as well as a section 7 report after - however my solicitor and barrister advised that their instinct is saying to not request for a fact finding hearing and push more towards a section 7 report only - reasoning being is because they said it’s stressful traumatic going through a fact finding hearing and also gives ex the chance to pull out “things on me”. My barrister said I should have a think about it properly and decide what I want to do.. I would be grateful if any of you ladies could advise me on this what would be best? Thanks x

My solicitor advised me to not pursue a fact finding hearing either. Which is hard to accept as there’s a lot of lies in the reports that I want to straighten out as it doesn’t seem fair how a judge can make a decision of documents that are not correct. But mentally it would be more trauma and things will be used against me. But it would be even more trauma is the court didn’t do what’s best for my daughter with the right information. My BD didn’t want to pursue a fact finding but I think it may be because he can’t afford the ongoing court cost and has been borrowing money. He is currently having supervised contact only but is wanting full custody. It’s mind *uck honestly. If you believe you will get what’s best for your child without a fact finding then listen to solicitors advise if they have enough experience in family court to be advising that.

Thanks Julie
