Enhanced mat pay pay back

Has anyone been in a situation where you have left your job within 12 months of coming back from mat leave and have had to pay back any enhanced mat pay that your company paid you?

Not me but if such policy exists it needs to be in the employee handbook

It was in the “enhanced maternity policy” that they made up specifically for me as I was the first employee to go on mat leave. I didn’t however sign it. I’ve been told it’s very hard claim the money back, so wondered if anyone had managed to break away without having to repay

I had it from my work. I imagine they could sue you. Although you didn’t physically sign the document by receiving funds I believe you’d be accepting the contract via actions. I’m currently waiting my year out until I can look around x

Enhanced pay is entirely up to the employer so yes, they can do what they want and you don’t need to sign for it to be applicable. But they can’t change the rules *AFTER* finding out that you’re pregnant, certainly not if it will put you at a disadvantage. So if there was any formal mention of enhanced mat pay before you announced your pregnancy and they added a clause about repayment after your announcement then it would be specifically targeting you and this is considered pregnancy discrimination, so in two words it’s not legal in this case.

I worked for the NHS and had to pay my OMP (occupational maternity pay) back as I didn’t return back. The NI and tax was deducted plus all the annual leave and bank holidays accrued. Just the at it is unfortunately but I wasn’t ready to leave my daughter so something I’ve accepted.
