You can’t get a fine for a child under 5 :)

As they are summer born they don’t have to able there all of year R. The school might not like it but that’s the law

At the parents evening the head teacher said we couldn't and we will face a fine if we do.. which i thought was slightly out of order as they are still young.

Unless he was referring to the ones older in the year.

The fine comes from the LA not the school. He can say what he likes but the law is that children MUST receive a full time education from the term after turning 5, before that it’s optional

I was trying to explain this to my husband and I swear he wasnt believing me.

The head teacher is probably saying it to scare parents!

The head teacher is going to say that to scare the parents but he cannot enforce a fine when the law states they don’t legally need to be in school until the term after they turn 5. Ignore him and go on holiday 😂

Are you sure she didn’t mean in general, throughout their school life. I’m not 100% certain but tend to agree with the others that they don’t have to legally be in school till age 5 and therefore can’t be fined. My idea is to take my daughter on holidays the week before the school holiday starts and then by the time she’s back at school she will either of forgotten about it or I’ll be able to say it was actually in the school holiday we went away but she was ‘sick’ before that. She’s 4 what does she know 😂

We usually go in September but I personally didn’t want to this year as I think it’s important that he is in for at least the first term more for him settling. That’s why we’ve booked after Xmas when he would’ve done more than half the year already.

I would imagine they are talking about the children that are 5 and statutory school age! But if they said oh if you do it before your child turns 5 then it’s not a problem then they’d be faced with loads of people taking their child out x

We’ve booked in October, week before half term and the week after 🤷‍♀️ we know we face a fine for the older 2 but not for maxi!

As a teacher, the school don’t control the fines, it is the local authority and attendance is sent to the DfE each day. They just want your child to have as much time in school as possible as you’d be surprised the impact being off has and the amount of children who are persistently absent. It is also hilarious from a teacher view as EVERY child tells us they’re going on holiday no matter how old (I teach year 1 and they physically can’t hold info like that in!) and all of their friends will also tell the teacher so there’s no point lying 😂 just go and enjoy yourselves

Definitely is ok until they are 5 because they don't even legally have to be there at 4, they might try to scare or say it's that school policy but they can't enforce it even if they tried.

My friend went to Tunisia a couple months ago & they received a fine. £80 each adult. I said the same thing, I thought it was after 5 but she did receive a fine and had to go into the school and speak with the headteacher

I hope your friend didn’t pay the fine because legally she did nothing wrong. The law states it’s not compulsory until the term after they turn 5.

I said exactly that but she actually paid it 😩😩😩
