Moving out of the country

I have a 4 year old daughter. I am sole parent. Her dad only gets her on his two days off of work. We were never married and never went to court. We broke up before she was 1 but had to continue living together a couple months before she was 3. I filed child support against him once I moved out. He is allowed to get my daughter whenever he wants to. He refuses. He will only get her the 2 days he doesn't work. He rarely calls her or checks in on her. I am moving to Canada hopefully by the first of the year. I have already told him everything about moving. And he said ok. I've asked him if he is going to go for custody and his response was 'why would I?'
I plan to have a contract written up stating that I am taking her. I have already told him he can get her in the summer time when school is out and I would even pay half of her plane ticket. He just has to come get her. And then I would go pick her back from him.
I do not see this happening. I do not see him trying very hard at all. She is 100% a momma's girl.
Does anyone here know if I truly would need to go to court to move? I have screen shots of his texts saying ok and all the other stuff when I told him about the move.

I’d say it’s way safer to go to court. Worse case scenario you don’t go now and he drags you back later.

always go to court. parents always decide last minute they wanna take it to court. had it happen to me with my parents. same happened with my siblings and their dad.

YES! Always get everything in writing. I know it seems a chore for some things but it protects you! As for moving, make sure he puts in writing that he knows the full details of where you’re moving and when and that he’s ok with it and isn’t going to seek any custody arrangements.

If your don’t have a custody order saying you can’t move then you do not have to go to court. Only when there is already a custody order in place. (I know because I have one)

correct but the father very well could decide after the move that he wants to take action. happened to my mother and many others that i know. helps to have it in writing before leaving that he doesn’t care to fight custody.

Go to court and get a relocation paper filled. If not he can take you and it’s considered kid napping. Or write a letter y’all both sign and get it notarized immediately
