My daughter’s dad has got in touch with cms saying that he isn’t her dad. I don’t have any evidence that he is so they are doing a dna test. He has to pay for it xx

Yes and if hes the father then he will have to pay maintenance, if hes not the father than he wont have to pay. You dont pay for dna

He is dad and he knows this. I didn’t put him on the birth certificate due to a lot of safety reasons. He denied being dad when I applied and said he did this on purpose to get dna to apply for his rights what can I do ?

You dont need to do anything. He will have to pay for and do a dna test, if he refuses he still pays maintenance. Its not an issue. Also you wouldnt have been able to put him on birth certificate unless he goes with you anyway and you can still get maintenance

What rights does he mean?

he said he wants his name on the birth certificate to get PR He said he needs it that’s what his solicitor told him that’s why he denied on purpose

Oh he can probably do that but if you said safety concerns he might not be able to. Keep all evidence of risk concerns. It might end up going to court if you both dont agree. X

I just think it’s silly I have to do a dna when he also knows he’s the dad and was paying some money until I went to CMS

Going to CMS and denying he’s dad to get a dna test, won’t automatically get him PR’s and name on birth certificate. He needs to apply to court for that, which is expensive! Won’t look too good on him denying paternity just to force a dna if you can show evidence of that being his plan! As he could of easily applied and court could of granted an order for a dna test as well.

Let me know when you do the dna test? I'm going though exactly the same thing. My ex is the fath3r of my child and I applied for cms but he disputed everything so ik expected to do fna test but I havnt heard anything from cms. It's annoying to put us through this!

Yh I'm happy to do it because I know ow the truth. But apparently cms have been trying to co text him to pay and get it booked but I think he is avoiding their calls to delay everything.
