Child maintenance

First question: What percentage of child maintenance is taken from a fathers salary if mum is full-time caregiver? Second question: My partner has 2 children from a previous relationship. In the event that his ex issues him to pay child support through CMS, would I as his new partner and mother of his newborn be able to also take him to CMS also and reduce the outgoings to the ex? Bear in mind we are not married we just live together but are boyfriend and girlfriend. This is just a hypothetical scenario and not our current situation I was just wondering how it all works

You can put all the details into the CMS calculator online and it will give you an idea. His payments to his ex will be reduced if he has other children he has to provide for x

All kids would get same entitlement right? CMS doesn’t favour one over an other. But only when you’re separated. Not under the same roof. 🤔

My partners CMS only reduced by £20 month when he added our baby to it so I'm not sure how that part works

@Shauna ok thanks, he does work in a commission based role so not sure how easy it would be to calculate but I’ll have a look x

@Elisha so do they divide equally per child ?

You could try using his basic wage or an average? My partners payment is really high right now because they calculated it from the last year when he was earning more 😐 x

@Shauna was you aware of the new amount send to previous family?

For the 1 child, it's 12%. For 2, it can go up to 25% - it depends on cms. In my experience, they seem to take what they want when they want, but this is what they're meant to take. We are in the process of trying to get a subject access request because they keep saying my partner is in arrears, despite child maintenance taking the amount they set, each week. They don't seem to like giving out this information. If the father lives with a child, who is a dependent, then that will be taken into account. Online, it suggests that if the father is the only person working in the household with dependents then the dependent takes priority. I'm not sure I trust that this is what actually happens
