Sometimes the victim can lose custody, temporarily or permanently also
In my experience, I was able to file for a temporary restraining order which included my child.
Unfortunately, unless there is documentation of him physically beating the children, eventually you will have to share custody.
You also have to be aware that you cannot simply move the child out of the established residence with due court process, because this can cause you to lose custody.
