Removing dad off birth certificate

@Siobhan yes I am trying to get a court order as he was abusive

@Christine they won't remove him from the birth certificate for being abusive. The court will only remove him from the birth certificate if it is proven he is not the father. Both links in my image above are reputable as one is the official Gov website and one is Citizens Advice Bureau.

You would need to make an application to court to remove his parental responsibility (PR). The Court will only remove PR in very, very rare circumstances x

@Siobhan the court can remove PR even if he is the biological father but again, success with these sorts of applications is incredibly rare. The behaviour to warrant removal of PR must be exceptional or extreme x

@Dee well my own father was abusive to both me and my mother, and I've friends who have been in abusive relationships, had kids with said abusers, and not managed to remove the name. Best they got was the ex/dad signing away his legal rights in a court as they weren't interested in the kid anyway. But never known their names to be taken off of a birth certificate for their behaviour/actions.

@Siobhan but was the dad prosecuted ect?

@Christine two of them were, one of them wasn't. But the one that wasn't already had an extensive prison record and police record as it was, that was my dad.

@Siobhan yes, that’s why I say it’s possible but incredibly rare. Usually the court will suspend contact or order supervised contact but will not remove PR x

@Dee I know. She can have contact stopped but likely won't be able to have name removed from birth certificate.

They can take away parental rights if he's dangerous and if you go to court. He won't be removed off the birth certificate though. That's vital records.

@Christine that will help court stop him from coming near you and your child, but it's very unlikely to have him removed from the birth certificate. He would only be removed from the birth certificate if you could prove he wasnt the father. But the court would put a stop to him being able to come anywhere near you and your child.

@Siobhan so can they stop all contact completely between him and me/ my daughter ?
