Does anyone have any idea about these things please.
I requested a SMP1 form of my employer as I won’t qualify for SMP due to being a part time worker. My message stated ;
- my request for xx date to start maternity leave.
- my address as I’ve asked them to update it multiple times in the past year and they haven’t.
- the fact I haven’t received any payslips since being force out of work due to complications.
Now a month later I still haven’t had any response so messaged them again this morning stating legally they should’ve replied within 28 days and they’ve got back to me with an incomplete smp report , incomplete smp1 and both still have my old/incorrect address on.
Does anyone know who / how I make a complete about the company for the following reasons :
- we don’t receive payslips before pay day as legally required and haven’t even attempted to get them to me since being out of work for the past few months.
- we aren’t always paid on time , it seems to be when the boss can be bothered
- they have ignored official requests to change personal details they are supposed to keep upto date for hmrc .
- I was heavily discriminated when I first told them about being pregnant, I unfortunately don’t have proof of this as it was a face to face interaction but I do have proof that they have ignored my communications to them multiple times since.
- they’re giving me incomplete invalid documentation regarding maternity.
I have tried to ignore it and get on with my time away from work as I will not be returning after baby is here however I don’t feel I should ? There were red flags before I got pregnant and since being pregnant the true colours of the company have really come out . There’s only 10 staff members at this franchises and since I’ve been out of work over the past few months they’ve lost 6 members of staff and had to hire replacements. It’s such a poor work place and I don’t want to see anyone else go through what I have.

This sounds like a rubbish situation to manage! Im no expert but have got some recommendations for place to turn to that might help - union (if you are part of one), Citizens Advice bureau, and ACAS. I’ve popped links below to the websites of these two as a starting point for support.

Hello, I am HR professional and I highly recommend you reach out to ACAS to complete something called an Early Conciliation- it is essentially a legal threat to your employer that you will take them to tribunal for "constructive dismissal on the grounds of pregnancy related discrimination" and failure to follow a reasonable request to update personnel details where they have a responsibility to maintain accurate payroll records. Whilst you don't need direct evidence for how they have treated you, the fact you have left because of it contributes to the constructive dismissal. Under ACAS Early Conciliation they could settle with you (doesn't always happen if they're big risk takers) or you could take them to tribunal. Most companies won't take that risk and I'd recommend avoiding going to whole hog as they're public and a future employer could easily Google your name and see the case come up (which wouldn't happen under EC).
