Going through custody battle with my child’s father I wanted to know if anyone could give me some advice! The father and I lived separately the whole first 14 months of my sons life and I took care of him primarily by myself he never came to visit or came to help out with him or spent anytime with him unlesss I packed everything and drove 45 minutes to his place to spend one night there in hopes for him to help me in the slightest I still did 99% of the work when visiting him and that wasn’t even every weekend sometimes every other weekend at one point I didn’t go over for 2 months and in that 2 months he didn’t see our son at all. Fast forward to may he got an apartment for us we moved in in hopes he will help more and be more physically present in our sons life but he wasn’t he spend little to no time with him he worked Monday - Friday by the time he got home there was hour before our sons bedtimes he would play video game or watch podcasts instead of spending time with him the only thing I asked him to do was atleast help with bath time which he complained about every night. While living together I went to my moms every weekend with our son to get him out of the house and fun things and go to church etc but his father never wanted to come because he was too tired his excuse was always that he’s too tired. About 2 months ago he went through my messages with my mom while I was sleeping and saw how I was venting about how poorly he treats me and how mean he is to me (he was verbally abusive and has been physically abusive in the past) he didn’t like that I was telling my mom things so I woke up to him throwing things at me telling me to get out he then started getting really aggressive towards me while I’m holding my son and trying to get our things so I had to call police to escort him out. We only lived together for 4 months. I had met up with him about a week after to discuss child support since he financially cut me off and I’ve been staying at home with no income to take care of our son so he could work but once I mentioned child support he immediately said he wants 50/50 custody which I find shocking as he hasn’t shown any interest in being around our son his whole life. But now here’s my dilemma I don’t feel comfortable with my son going with him alone as he has a history of violence on his record and multiple duis and is currently on probation with a felony for violence I fear for my sons safety being alone with him.. do you think the judge would agree to supervised visitation?

File for a protection order. Ask for sole physical custody. Look for legal help. Many states offer free legal aid to single moms with no income. I didn't pay anything and got sole custody of my daughter

File for a restraining order and add your son. The police call alone will add credence to your claim. I’m not sure your location but in CA, its minimum 5 years supervised visitation with a RO for domestic violence or abuse. He sounds abusive and toxic.

If you’ve allowed him around with no problem issue then it may look bad on you for bringing up dv as a reason and violence but then still moved in with him. You can ask for it but it just depends on the judge. Police reports, protective orders etc would help if you do have any or have in the past. Filing a protective order a month after it happened could end up being granted but doing it just to keep your son away from him could backfire if custody is the only reason why. From what you said it doesn’t sound like he makes or puts any effort into seeing him
