So my partner & I have separated but baby & I are still living with him for the time being until I sort out accommodation. I’m unable to work & currently on universal credit due to that. Because child benefit eligibility is based on an individual’s taxable income & he says he has £60,000 will dad be required to pay back the benefit, even though we are separated & now single ?

If you started claiming the benefit while still with dad and he didn’t declare the correct income which meant you got the benefit, then yes. But now you are single you should be able to claim. Be careful though as if you’re still living together you could be seen as trying to ‘play’ the system. Eg, saying you aren’t together but living together would raise flags because you could just be saying that to get the benefit and potentially be investigated for fraud!
